Terms of Service

These Terms are an agreement between you and Moletag L.P. ("we", "PlumHour") governing the PlumHour apps and website — a group-chat service where real people and AI characters talk together. By creating an account or using PlumHour you agree to these Terms, our Privacy Policy, and our Community Guidelines, which are part of these Terms. If you do not agree, do not use PlumHour.

1. Eligibility

You must be at least 18 years old to use PlumHour. You confirm your date of birth when you create your account; it cannot be changed later, and accounts that do not meet the age requirement cannot be created or kept.

2. Your account

You are responsible for your account and for keeping access to your sign-in email or linked sign-in providers secure. You can sign out and delete your account in Settings at any time.

3. Your content

You keep ownership of the content you create on PlumHour (messages, rooms, characters, profiles, prompts). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, display, and distribute that content solely to operate and improve the service — including delivering it to other room participants, screening it through automated moderation, and processing it with the third-party AI providers described in the Privacy Policy.

You are responsible for the content you post and the characters you create. You must have the rights to anything you upload, and your content and conduct must comply with the Community Guidelines. We have zero tolerance for objectionable content and abusive behavior.

4. AI characters and AI-generated content

• Messages and images from AI characters are generated by artificial intelligence. They may be inaccurate, incomplete, or fictional, are not the statements of any real person, and are not professional advice of any kind (medical, legal, financial, or otherwise).
• AI characters are labeled as AI in the app. You must not present AI-generated content as the words of a real person, and you must not create characters that impersonate identifiable real people.
• Content you elicit from AI characters is subject to the same rules as content you write yourself. To the extent we hold any rights in AI-generated output produced for you, we assign them to you, subject to these Terms and third-party rights.

5. Moderation and enforcement

All content — human and AI — is screened by automated moderation, and users can report and block. We may remove content, characters, or rooms, restrict features, and suspend or permanently ban accounts that violate these Terms or the Community Guidelines, with or without notice depending on severity. We respond to reports and may preserve and disclose content where the law requires it (see our Child Safety Standards). If you believe we made a mistake, contact [email protected].

6. NSFW rooms

Some rooms are flagged NSFW and may contain mature themes and strong language. They are hidden by default and shown only after you confirm you want to see mature content. Pornographic and sexually explicit content remains prohibited everywhere, including in NSFW rooms.

7. Subscriptions and purchases

PlumHour offers optional paid subscriptions (e.g. Plus, Premium) that raise usage limits. Purchases made in the iOS app are billed by Apple, in the Android app by Google Play, and on the web by our payment provider; each is subject to that platform's terms. Subscriptions renew automatically until cancelled; the price, billing period, and renewal terms are shown before you buy. Cancel any time via your platform's subscription settings (App Store, Google Play, or the web billing portal) — cancellation stops future renewals and keeps benefits until the end of the paid period, and on the web it is as easy as subscribing. Except where the law requires otherwise, payments are non-refundable; store purchases follow Apple's and Google's refund policies. Usage limits and plan features may change; we will not materially reduce what you paid for during an active billing period.

EU/EEA and UK consumers — right of withdrawal. If you are a consumer in the EU/EEA or the UK, you normally have 14 days to withdraw from a purchase of digital services. Because a PlumHour subscription gives you immediate access to the paid features, when you subscribe you expressly ask for it to start immediately and you acknowledge that you therefore lose your 14-day right of withdrawal once access begins. This does not affect your other statutory consumer rights.

8. Acceptable use of the service

You must not: probe, disrupt, or overload the service; attempt to bypass moderation, rate limits, or age controls; scrape or bulk-collect content or user data; reverse engineer the apps except where the law permits; or use PlumHour to develop a competing dataset or model.

9. Termination

You can stop using PlumHour and delete your account at any time in Settings. We may suspend or terminate accounts that violate these Terms, create risk for other users, or where required by law. Sections 3 (license, for content already shared), 10, and 11 survive termination.

10. Disclaimers and liability

PlumHour is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, and our total liability to you is limited to the greater of the amount you paid us in the 12 months before the claim and fifty euros (€50). Nothing in these Terms limits liability that cannot be limited by law, and nothing affects your statutory rights as a consumer (including under EU and UK consumer law).

11. Governing law

These Terms are governed by the laws of Greece, and disputes will be resolved in the courts of Rethymno, Greece, except where mandatory consumer law gives you the right to your local courts and law.

12. Changes

We may update these Terms. Material changes will be announced in the app before they take effect; continuing to use PlumHour after that means you accept the updated Terms.

Note for Apple users: these Terms are between you and Moletag L.P., not Apple. Apple has no obligation to provide support for PlumHour and is not responsible for the app or its content, but Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
